By downloading or using Pin & Fun (“the app”), you agree to these Terms and to our Privacy Policy (https://onexistech.com/apps/pin-and-fun/privacy/). If you do not agree, please do not use the app.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial entertainment, subject to the usage rules of the App Store. If you downloaded the app from the Apple App Store, Apple’s Licensed Application End User License Agreement (the “Standard EULA”, https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. If these Terms conflict with the Standard EULA, the Standard EULA controls for apps obtained from Apple.
2. Using the app with children
Pin & Fun is a general-audience party game that families can enjoy together. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. Parents and guardians are responsible for purchases made with their Apple Account and can control them with Apple’s Family Sharing, Ask to Buy and Screen Time settings.
3. Free features and paid features
The app offers free features and optional paid features:
- Free: countries, capitals and Clues, this month’s history, Daily Pin, share cards, 3 themes, party games with up to 3 players (one first party with up to 8), 20 solo questions a day and 2 Point & Find games a day. Daily limits reset at midnight on your device.
- Pin & Fun Plus (US$5.99): a one-time purchase that unlocks additional features, including unlimited solo play.
- Region packs (US$1.99 each): one-time purchases of additional question packs. Pin & Fun Plus is required.
- Pin & Fun Pass: an auto-renewing subscription that includes everything in Pin & Fun Plus and all region packs available while your subscription is active, including any new region packs we release during that time.
- Pin & Fun Pass · 6 Months: a non-renewing pass provided only through promotional codes. It includes the same content as Pin & Fun Pass for 6 months from the date the code is redeemed, then ends on its own. It does not auto-renew, no payment is charged, and Family Sharing is not supported. It is kept on the device and app installation where it was redeemed. If you delete the app or change devices, it may not be restored automatically; contact support@onexistech.com with the Support ID shown at the bottom of Settings, and we will add the remaining time back.
Promotional codes are provided only as Apple Offer Codes and are redeemed through Apple. Each code can be used once, is personal to the person who received it, has no cash value and cannot be sold or transferred. A code must be redeemed before the expiry date set for it (no more than 6 months after it is issued), and each person can redeem one code per offer. We may deactivate codes that are shared publicly or misused; this does not affect a Pass already redeemed. Apple’s terms apply to redemption.
Prices shown are US prices. Prices in other countries are shown in the app in local currency before you buy and may include taxes. What each product includes is described on the Plans screen.
4. Subscriptions (Pin & Fun Pass)
- Pin & Fun Pass is available as a 1-month subscription (US$1.99 per month) or a 1-year subscription (US$11.99 per year). There is no free trial.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically at the same price and length unless it is canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. If the price changes, Apple will notify you as its rules require.
- You can manage or cancel your subscription in your Apple Account settings (iPhone: Settings → [your name] → Subscriptions, or App Store → your profile picture → Subscriptions). Deleting the app does not cancel a subscription.
- When a subscription ends, Pass content is locked again unless you bought it separately. This includes Pin & Fun Plus features and region packs. Your progress stays on your device.
5. Refunds, restoring and Family Sharing
- Purchases are processed by Apple. Refund requests are handled under Apple’s policies (https://reportaproblem.apple.com).
- You can restore past purchases on a new or reinstalled device with Restore Purchases on the Plans screen, using the same store account.
- Pin & Fun Plus, region packs and the Pin & Fun Pass subscription can be shared with family members through Apple Family Sharing, under Apple’s rules. Pin & Fun Pass · 6 Months is not available through Family Sharing.
6. Your content
You may enter names, choose a nationality and add face photos. This content stays on your device. Only add photos of people who agree to it, and of children only with a parent’s or guardian’s permission. You are responsible for what you share outside the app using share cards or backup files.
7. Acceptable use
Please do not: copy, modify, reverse engineer or resell the app except as allowed by law; use the app for anything unlawful; interfere with the app’s servers (for example, by sending fake Daily Pin scores or votes); or use automated means to manipulate scores, votes or leaderboards. We may remove scores or votes that appear invalid, and may disable server features for abusive use.
8. Educational content and place names
Questions, maps and facts are provided for entertainment and general education. We work hard to be accurate and neutral, but we can’t guarantee that every fact, boundary, coordinate or name is complete, current or error-free. Maps and place names in the app do not express any opinion about the legal status of any country, territory or border. If you spot a mistake, please tell us at support@onexistech.com.
9. Location, compass and safety
Point & Find uses your phone’s compass and approximate location, which can be inaccurate, especially indoors or near metal and electronics. Do not use the app for navigation. Some games involve pointing or moving your phone and passing it between players. Play only where it is safe to do so: do not play while driving, cycling or crossing streets, hold your phone securely, and watch out for people and objects around you. Adults should supervise young children. You use the app at your own risk.
10. Third-party services
The app uses third-party services such as Apple’s App Store, RevenueCat, our cloud provider and NASA map services. Their own terms and privacy policies apply to their services.
11. Apple-specific terms
If you got the app from the Apple App Store:
(a) These Terms are between you and Onexis Technologies, LLC, not Apple, and we (not Apple) are responsible for the app and its content.
(b) Apple has no obligation to provide maintenance or support for the app.
(c) If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the extent permitted by law, Apple has no other warranty obligation for the app.
(d) We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
(e) We, not Apple, are responsible for investigating, defending, settling and discharging any claim that the app or your use of it infringes a third party’s intellectual property rights.
(f) You confirm that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.
(g) Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
12. Intellectual property
The app, including its design, characters, text, questions, graphics and sounds, is owned by Onexis Technologies, LLC or its licensors and is protected by law. 13. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not guarantee that the app or its online features will always be available, uninterrupted or error-free.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ONEXIS TECHNOLOGIES, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP AND IN-APP PURCHASES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$50.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct, or any other liability that cannot be limited under applicable law. If you are a consumer in the EU or UK, we are responsible for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care, and you keep your statutory rights, including rights relating to digital content that is not as described.
15. Changes and termination
We may update the app and these Terms. For material changes, we will update the dates above, post the new version at https://onexistech.com/apps/pin-and-fun/terms/ and let you know in the app before the changes take effect. If you keep using the app after the effective date, you accept the updated Terms. You can stop using the app at any time. We may suspend access to online features if these Terms are violated.
16. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Georgia, and you and we consent to the jurisdiction of those courts, except that either of us may bring an individual claim in small-claims court. If you are a consumer living in the EU, UK or another country whose law gives you the right to sue in your home courts or to rely on mandatory local consumer protections, nothing in these Terms takes those rights away.
17. General
These Terms, together with our Privacy Policy and (for apps obtained from Apple) the Standard EULA, are the entire agreement between you and us about the app. If any part is found unenforceable, the rest stays in effect. If we do not enforce a term, we have not waived it. We may transfer these Terms as part of a merger, acquisition or sale of assets. You may not transfer them without our consent. If you send us feedback or suggestions, we may use them without any obligation to you.
18. Translations
These Terms may be available in other languages. If translations differ, the English version controls, except where local law requires otherwise.
