Launch & Orbit — Terms of Use

These terms are an agreement between you and Onexis Technologies, LLC (a Georgia limited liability company), 8735 Dunwoody Place, Ste N, Atlanta, GA 30350, USA (“we”). They cover the Launch & Orbit app. By using the app, you agree to them. If you don’t agree, please don’t use it.

Age: the app isn’t directed to children under 13. If we learn that we have personal information from a child under 13, we delete it.

1. Apple’s terms

You get the app through Apple’s App Store. Apple’s Standard End User License Agreement also applies. If it conflicts with these terms, the Apple agreement controls for the app’s license. In addition:

  • These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • Apple has no duty to provide maintenance or support for the app.
  • If the app fails to meet a warranty that applies, you may tell Apple, and Apple may refund the purchase price. Apple has no other warranty duty for the app.
  • We, not Apple, handle claims about the app, including product liability, legal compliance, consumer protection and intellectual property claims.
  • You confirm that you’re not in a country under a US government embargo and not on a US government list of restricted parties.
  • Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries.

2. Free play and paid plans

The app is free to download. Daily Launch, streaks, sharing and viewing leaderboards are free. Other free play has daily limits, which are shown in the app.

PlanWhat it isUS price
Orbit Pass · MonthlySubscription, renews every month$3.99 a month
Orbit Pass · YearlySubscription, renews every year, with a 7-day free trial$24.99 a year
All AccessOne-time purchase, no renewal$49.99 ($39.99 for the first 30 days after release)

Prices vary by country, and the App Store shows your price before you confirm. We may change prices, and Apple will tell you when a subscription price change requires it.

3. How subscriptions work

  • Payment: Apple charges your Apple ID when you confirm the purchase.
  • Renewal: a subscription renews automatically at the same length and current price, unless you cancel at least 24 hours before the current period ends. Apple charges your account within 24 hours before the period ends.
  • Free trial: the yearly plan starts with a 7-day free trial. When it ends, it changes to a paid subscription automatically and you’re charged $24.99 a year, unless you cancel at least 24 hours before the trial ends. Each person can only use the trial if Apple says they’re eligible.
  • Canceling: open your Apple ID settings, choose Subscriptions, choose Launch & Orbit and cancel. Deleting the app or your data doesn’t cancel a subscription. After you cancel, you keep access until the paid period ends.
  • Both plans: buying All Access doesn’t stop a running subscription. You need to cancel it yourself, or you’ll keep being charged.
  • Refunds: Apple handles all refunds under its own rules. Ask at reportaproblem.apple.com. We can’t refund App Store purchases ourselves.
  • Restoring: on a new device or after reinstalling, sign in with the same Apple ID and go to Store › Restore purchases.

4. The 6-month Commander pass

We may give access codes to some people, such as content creators, for the “Orbit Pass 6-Month (Promo)” product.

  • It’s free and gives the same benefits as Orbit Pass for 6 months from the day you redeem the code.
  • It never renews and turns into nothing else. You will never be charged for it.
  • When it ends, the app returns to the free plan.
  • Apple checks codes. Each code works once. Codes have a deadline, can’t be sold and aren’t for people who’ve already bought something in the app.

5. Virtual items and rankings

  • Rockets, satellites, levels, ranks, badges and scores are virtual. You get a limited, personal license to use them in the app. They have no cash value, you can’t sell or transfer them, and you don’t own them.
  • We may add, change or remove content and game rules, including limits and how scores work. If we remove something you paid for, we’ll try to offer something fair in its place, as far as the law requires.
  • Rankings may be recalculated or reset. We may remove scores that look wrong or come from cheating.
  • Viewing rankings is free. Taking part in the Weekly Challenge rankings needs Orbit Pass, All Access or the Commander pass.
  • The app is a game. Its physics, missions, weather and launch dates are simplified, may be wrong and aren’t for real-world use.

6. Pilot names

  • Your pilot name must not be hateful, sexual, threatening or misleading, or impersonate anyone, or include private information.
  • The app filters names. We may change or remove any name, and we may hide or block players.
  • You can use “Report this name” and “Hide this player” on leaderboards.
  • Tell us about a problem at support@onexistech.com. We review reports and act on those that break these rules.

7. What you must not do

  • Cheat, change the app or its scores, or use bots or automated tools.
  • Copy, resell or reverse engineer the app, except where the law allows it.
  • Attack, overload or interfere with the app or its services.
  • Harass other players, or break any law while using the app.

If you do, we may limit or end your access, as far as the law allows.

8. Our content and yours

The app, its design, code, models and text belong to us or our licensors. We give you a personal, non-transferable license to use the app on Apple devices you own or control, under Apple’s rules. You keep the rights to what you create, such as a pilot name. You let us use it as needed to run the app. Music, imagery and data from others are credited in Settings. NASA doesn’t endorse this app.

9. Disclaimers

The app is provided “as is” and “as available”. As far as the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the app will always work, be free of errors or keep any feature. Some places don’t allow these limits, so they may not all apply to you.

10. Limit of liability

As far as the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim is limited to the greater of what you paid for the app in the 12 months before the claim, or $50. Nothing here limits rights that can’t be limited by law.

11. Governing law and disputes

The laws of the State of Georgia, USA, govern these terms, without regard to conflict of law rules. If you have a problem, please email us first, and we’ll try to solve it within 30 days. If we can’t, any dispute must go to the state or federal courts located in Georgia, USA, and you and we agree to their jurisdiction. If you live in a country whose consumer laws give you other rights or courts, those rights stay in place.

12. Changes and ending

We may change these terms. We’ll update this page and the effective date, and tell you in the app if a change is important. If you keep using the app after that, you accept the new terms. You can stop at any time by deleting the app. If a part of these terms can’t be enforced, the rest still applies.
